Message to Friends (April 2, 2007):

Dear Friends,

First, I would like to thank all of the people all over the world who have helped me through the divorce ordeal of the last 4 years and to those people who were truly understanding during the previous fifteen years, while I was involved in a difficult marriage. I am extremely grateful, particularly to my two daughters who provided strong emotional support. I debated for quite some time about going public with my case, but, in the end, I decided that the United States of America needs to be about justice for all peoples.

Those of you, who know me well, know that my going public is not about personal material gain as I have lived an extremely modest existence for many decades - 2 pairs of jeans, some tee shirts, a few pairs of socks, a $25.00 Casio watch, 2 pairs of shoes, 1 pair of sneakers, 1 suit, and 1 sport jacket and pants (for NSF meetings), no furniture, and an automobile only when necessary. I regret that my two natural children and my grandson have been disinherited as a result of my poor judgment and I vow to reconstruct their legacies over the time I have remaining.

Many Americans believe that the civil rights movement successfully concluded in the 1960s after the murders of John Kennedy, Malcolm X, Martin Luther King Jr., and Bobby Kennedy. Subsequent events have proven the contrary: e.g. (1) forced busing and the National Guard in Boston schools (1975 - 1995); (2) the Charles Stuart "blame it on a Black man" murder case (1989); (3) the Rodney King police beating case (1991); (4) the OJ Simpson murder case (1995); (5) the Jasper Texas pickup truck dragging death case (1999); (6) the Duke Lacrosse team Rape case (2006); and the recent rash of verbal attacks on Blacks(Trent Lott, Michael Richards, Imus, ...)

The racial climate in metropolitan Boston is particularly disgraceful and has worsened significantly over the last thirty years under the guise of legitimacy. Jack Nicholson's monologue from the opening scene of the 2006 movie, The Departed, not only captures the true racial tone in metropolitan Boston at that time, but an enduring legacy of racial bigotry perpetuated through daily support of bias against Blacks. As the movie opens, the following overlay is displayed on the screen and Nicholson states:

Boston Some Years Ago

"I don't want to be a product of my environment. I want my environment to be a product of me. Years ago we had the church. That was only a way of saying we had each other.

The Knights of Columbus were real head breakers, true Ginnies. They took over their piece of the city. Twenty years after an Irishman couldn't get a fucking job, we had the presidency. May he rest in peace.

That's what the niggers don't realize. If I got one thing against the Black chappies, it's this:

No one gives it to you. You have to take it!"

A Follow-on Message to Friends (July 27, 2007):

Dear Friends,

I felt compelled to write this update as rumors are floating around that I am some kind of criminal. The Commonwealth of Massachusetts has declared me in contempt of court and declared that I have failed to make child support payments.

Here is the chronology of actual events:

  1. After nearly four years of fighting this case, on November 15, 2006 trial was held in Cambridge, MA in my divorce case from Diane Palermo. The trial was presided over by Leilah Keamy. Michael Modestino represented Diane Palermo, and I represented myself.
  2. Apparently on November 30, 2006 Keamy released her judgment in the case.
  3. On December 21, 2006 the Middlesex County Probate Court mailed the judgment to me at 154 Jefferson Pkwy, Lake Oswego, OR. This was not the correct address. My address at that time was One Jefferson Pkwy Apt 154, Lake Oswego, OR. The court had mailed me a number of documents in the past at the correct address.
  4. On November 22, 2006 I left for China and I returned on January 2, 2007. Since I was under temporary court order to pay the mortgage ($2,259.12) on the residence at 28 Woodcliffe Rd, Lexington, MA occupied by Diane Palermo and Chandler York, I made the mortgage payment on December 1, 2006. Because I did not receive notice of Keamy's judgment, I assumed the temporary orders were still in place and I made the mortgage payment on January 2, 2007.
  5. The judgment provided for child support payments to be deducted directly from my Portland State University paycheck as a garnishment. It also provided that the amount be set to compensate for the fact that I do not receive salary during the summer. Twelve months of payments would be extracted over 10 months. I assumed that the payments would be subtracted beginning with my January 31, 2007 paycheck. Nothing was deducted on January 31, 2007.
  6. After I received the court's judgment on January 4, 2007, I immediately prepared a response and an accompanying CD of materials which I mailed to Massachusetts Governor, Deval Patrick, on January 5, 2007. After 3 weeks with no response, I prepared a letter and accompanying CD of materials for Mr. Hardy Myers, attorney general of Oregon. I included a copy of the divorce settlement, thus notifying the Oregon Department of Justice that Diane Palermo would be receiving a garnishment for child support from my salary at Portland State University. I also brought a copy of the letter and CD to the PSU Human Resources Department. They informed me that they could not deduct payments until Diane Palermo filed for the garnishment.
  7. On February 27, 2007 I sent a letter to Diane Palermo at 28 Woodcliffe Rd, Lexington, MA informing her that nothing had been deducted from my paycheck and that she needed to file for a garnishment under the terms of Keamy's divorce order. For a copy of that letter, CLICK HERE

Apparently Diane Palermo had decided not to apply for the garnishment during the whole month of December 2006, the whole month of January 2007, the whole month of February 2007, the whole month of March 2007 and the whole month of April 2007 and to arrange to have me charged with non payment of child support.
  9. On May 25, 2007 while I was in China I received an email from the Multnomah County Sheriff's Office that they needed to serve papers on me at my place of employment. I responded that I was in China and would return on May 28. May 28 was a holiday so I went to the Sheriff's Office on May 29. Deputy Sheriff Hughes was not available, so I asked to be served at my office on May 30. I was served papers on May 30, 2007 stating that I was in contempt of court and that I was required to send child support payments to the Massachusetts Department of Revenue. Also, on May 30, 2007 child support was automatically deducted from my paycheck as a garnishment, as well as on June 30, 2007.

My Position:

I fail to see how it is legal for Diane Palermo to choose not to follow the original court order issued on November 30, 2006; choose not to file the garnishment forms out of vindictiveness; have the original court order amended; have me declared in contempt of court under the amended order; and then receive payments under the original order through garnishment.

My Commentary:

This is simply another example of how white racists can manipulate the legal system to create fictitious infractions of the law in order to persecute Black people. I submitted the original court order to the attorney general of Oregon and I informed Diane Palermo that she had not filed the garnishment forms by letter on February 27, 2007. I did more than meet my responsibility under the law, in a case where I was defrauded of my home, my retirement, and my life savings by people who are essentially criminals. Something like this happens to 1,000 Black people each day. Because that is only 365,000 (1% of the total Black U.S. population) people per year and most of those people lack the means or voice to bring their case to the public, the abuses continue.

Even a cursory review of the materials at this website will show that Diane Palermo lied in order to get me to marry her; contributed almost nothing to the marriage; refused to contribute to down payment, mortgage payments, or any other household expenses (except food) when she was working; lied about her fathers work on the renovation of the home and refused to contribute to the renovation herself; maintained a separate residence from just after the inception of the marriage; attempted to legally disinherit my two children from my first marriage; and threatened to have me killed for the insurance money. As a reward, this person (who could not hold a decent job after graduating from college and who has never paid rent or mortgage in her entire life) was awarded 50% of the home, 50% of my retirement ($150,000.00) with which she can use to pay off the outstanding mortgage on the home; the right to purchase my equity in the home at a fake assessment of $600,000.00 created by her cronies; the right to remain in the home for 3 years; and $2,200.00 per month in child support (while making $50,000.00 per year as a document specialist). This person (who brags that her grandparents on both sides entered the country illegally, while simultaneously deriding Mexicans who have come to this country to work hard) was awarded custody of the child and received a certificate from the Massachusetts Parenting Course based on her ability to order pizza and properly situate her child in front of a TV set

I apologize if my commentary sounds bitter, but it is unfortunate that America has come to such a state. I have worked hard all of my life and I am proud to announce that I was awarded the first Footprints Award from the African American Researchers in Computer Science at the AARCS Conference on July 21, 2007.

Final Thanks

Finally, I would like to thank those friends who have allowed me to stay in their homes during this period of homelessness in my life. I will be back on my feet soon and I will always remember your kindness. I will not mention your names at this time for fear you will be persecuted as a result.
